All purchases, shipments and deliveries hereunder are subject solely to the following terms and conditions. All new or different provisions in Buyer’s Purchase Order or other documents are rejected.


As used herein, the terms set forth shall have the following meaning: 

1) “Wholesaler” or « seller » shall mean Bottle Express LLC.

2) “Buyer” shall mean the party purchasing the glass containers. 

3) “Containers”, « Products » and « Goods » means the glass container, bottle or bottle accessories being purchased.

4) « Manufacturer » shall mean the companies manufacturing the products distributed by Bottle Express LLC


WARNING: the use of this website and purchase of the advertised Products is intended for professional resellers of empty glass bottle containers and/or food and beverage professionals who intend to use the product as a container to package their products for sale.

The buyers certifies that the use of all purchased empty glass containers will be solely limited to the purpose of resale or to package goods for resale.Thus, the buyers is exempt from any taxes applied to the purchase of the corresponding empty glass container and the Wholesaler is exempt from any tax collection applied to the sell of empty glass containers. The Wholesaler reserves the right to request a resale certificate to the buyer. The resale certificate should be sent by email to customerservice@bottle.express within 48 hours from the Wholesaler’s e-mail request.


Prices and product specifications are subject to change without notice. Prices billed will be those in effect at time of shipment. Prices will fluctuate up or down based on the prevailing market conditions for each type of raw material. We reserve the right to update prices due to errors. For questions about our most current prices, please email our customer service customerservice@bottle.express 

All efforts are made to have accurate pricing and product specifications. In the event that a price or product specification is listed incorrectly, we reserve the right to refuse or cancel any orders placed for the product at the incorrect price.

All efforts are made by the Wholesaler and the Manufacturers to provide accurate stock information. However the Wholesaler reserves the right to change the stock without notice or fail to provide live stock information. In the event of Product sold without stock available, then Wholesaler will cancel the order and if Products have been paid, the Wholesaler will refund the buyer for the amount paid for the Products and freight ordered through the Wholesaler website only. The buyers will not request any additional indemnification of any kind.


The Wholesaler may deliver notice to the buyer by means of email, a general notice on the site, or by other reliable methods, to the address the buyer has provided to the Wholesaler. In the event that a problem occurs with the buyer’s order, the Wholesaler will attempt to contact the buyer two times via email or phone to resolve the problem. If, after two attempts within seven business days, we are unable to contact the buyer to resolve the issue, we reserve the right to cancel the order. It is the buyer’s responsibility to ensure that email spam filters are set to allow these notifications to be received successfully from the Wholesaler.
The buyer reserves the right to cancel any order that has been put on hold at the buyer's request for more than one month, a 50% cancellation fee will apply.
Orders placed and confirmed by the wholesaler to the buyer are not cancellable by the buyer.


A delivery note will be issued by the wholesaler to the buyer by e-mail to confirm the delivery date and special requirements. Special delivery requirements may possibly increase the freight price and will be billed by the Wholesaler separately. The buyer will be responsible for such additional cost. 

If the buyer choses to pick-up the goods at the given warehouse location, a release note will be  sent by e-mail to the buyer. The buyer should follow the instructions received by e-mail to schedule their pick-up. 

Tittle to Containers shall transfer to the Wholesaler upon receipt of full payment of the delivered Containers by Wholesaler. When Wholesaler is responsible for delivering Containers, risk of loss shall pass to Buyer upon delivery at Buyer’s location. When Buyer is responsible for picking up the Containers, risk of loss shall pass to Buyer upon release note is sent by the Wholesaler to the buyer.

Customers may exceptionally impose the freight / carrier / delivery service of their choice to Bottle Express. In this case, customers are deemed entirely responsible for the appropriate loading of the goods, the shipment and the delivery of the goods from the pick-up address to the final destination. Any claims, reimbursement or loss must be addressed to and filed directly by the customer with the freight/carrier/ delivery service they chose. Bottle Express will not be responsible for any damage of any kind with third party delivery providers. Customers will hold Bottle Express harmless of any issue, lawsuit, damages done or incurred by the third party freight / carrier / delivery service imposed by customers to Bottle Express.


Neither party shall, under any circumstances, be responsible for failure to comply with this agreement due to: fires; floods; riots; strikes; freight embargoes or transportation delays; shortage of labor; inability to secure fuel, materials supplies or power or significant increase in the costs thereof; acts of God or of the public enemy; any existing or future laws or acts of the federal, state or local government with which the appropriate party, in its judgment and discretion, deems advisable to comply as a legal duty; or to any cause beyond such party’s reasonable control.


Products are not returnable, refundable or exchangeable for any reason other than a quality claim accepted by the Wholesaler within 15 days of receipt.

All items sold are warranted by the manufacturer against failure caused solely by defective workmanship or material.

Wholesaler specifically disclaims any warranty or liability for:

  • (1) foreign substances of any kind in the product which reasonably could have been introduced by either Wholesaler or Buyer;
  • (2) any defects or breach of warranty which appear more than one (1) year from the date of delivery of the product; and
  • (3) the containers should be cleaned by Buyer immediately prior to filling, the container is filled under sanitary conditions and in accordance with good manufacturing practices as required or recommended by the Food and Drug Administration, and the container is suitably sealed immediately after filling with an appropriate closure.
  • (4) any use of Containers for purposes for which they are not designed or intended.

In addition to the above disclaimers, Buyer agrees that the products shall be utilized only under the following conditions and that Wholesaler shall not be responsible for any claims related to any inconsistent use:

  • (1) Containers shall not be subjected to vertical forces greater than 1000 psi;
  • (2) product fill temperature shall not exceed the ambient bottle temperature prior to filling by more than 75° F (42C).
  • (3) Buyer should follow the filling instructions of the container glass drawing provided on the corresponding product page of the seller’s website www.bottle.express

Wholesaler and/or a third party chosen by the Wholesaler such as the product Manufacturer or any other third party chosen by the Wholesaler shall be given an opportunity to conduct an adequate investigation of all claims of breach of this section both by inspection at the Buyer’s place of business and having the products returned to Wholesaler.

All claims must be made within 15 days of receipt. Please contact customer service by email at customerservice@bottle.express to file a claim. Returns will be exclusively limited to quality claims. For the claim to be accepted by the Wholesaler, the quantity of products at fault should exceed the Wholesaler AQL (Acceptable Quality Limit) as explained in the appendix section PRODUCT SPECIFICATION AND AQL at the end of the Condition of Sales.

In the event of an alleged breach of any of the above warranties, Buyer shall furnish Seller notice of any such breach of warranty within a reasonable time after discovery of the breach. As Buyer’s exclusive remedies for an actual breach of warranty, the defective or non-conforming product will be replaced by Seller free of charge or the purchase price thereof refunded, at Seller’s option and sole discretion.


Buyer shall indemnify and save Seller, its present and future directors, officers, employees, and agents from and against all third party claims, demands, suits and actions and any fines, penalties, damages and costs, including reasonable legal expenses and attorneys’ fees connected therewith, to the extent such is caused by the negligence, willful misconduct, or other act or omission of Buyer.


The Wholesaler liability on claims of any kind, including negligence, shall not exceed the price of the goods or services or part thereof which gives rise to the claim. In no event shall the Wholesaler be liable for any special, incidental, or consequential damages or for damage in the nature of a penalty for the use of, or the inability to use, the goods on this site or the performance of the goods, even if the Wholesaler has been advised of the possibility of such damages.

In no event shall Wholesaler be liable to any person or entity for loss of profit, loss of business, loss of business opportunity, loss of market share, damage to the goodwill or reputation of any party or its products, or for any special, indirect, incidental, punitive, exemplary or consequential damages however caused and under any theory of liability whether based in contract (including indemnity, breach of warranty or representation or other breach of contract), tort (including negligence), or otherwise. The foregoing limitations shall apply regardless of whether such party has been advised of the possibility of such damages and notwithstanding the failure of essential purpose of any limited remedy stated herein.

  • Buyer hereby agrees that, prior to providing any empty Container to any other commercial entity or party, Buyer shall obtain such party’s agreement to the limitations set forth herein and an acknowledgement that Wholesaler is a third-party beneficiary to such agreement for the purposes of such limitation. Buyer further agrees to fully indemnify Wholesaler for any and all claims made by such third-party commercial entity or party made against Wholesaler seeking any of the excluded losses or damages set forth above.


Neither the underlying agreement nor any interest therein may be assigned by Buyer, whether by operation of law or otherwise, without the prior written consent of Wholesaler, which consent shall not be unreasonably withheld.

The Wholesaler may assign its rights under this agreement or any of the rights arising out of or in connection with it, in whole or in part, at any time and more than one occasion to one or more members of its group or to a reputable provider of finance.  In connection with such assignments, the Wholesaler may disclose to such members of its group or finance provider the terms of the contractual arrangements between the parties.


The laws of the state of California shall apply to the interpretation and enforcement of this agreement, and jurisdiction over any disputes lies solely in the federal and state courts in Solano County, California.


No amendment or other modification of this agreement is binding upon the parties unless it is in writing and executed by a duly authorized representative of each party.



For glass containers

Reference documents:

  • Dimensional tolerances – NF H 35 077 standard
  • Thermal schock – NF H 35 078 standard
  • Capacity –NF H 35 077  standard and laws on measure containers, where applicable
  • Client must ensure that filling level is correct in order to avoid any negative consequences due to a bad filling. Filling levels are given above finish level and for a product at 20°C. Filling voids are calculated under normal conditions of use of the bottles.
  • Internal pressure –NF H 35 078  standards apply for models designed for use with carbonated products
  • Weight – Glass weight is not a discriminatory criteria provided that shape, dimensions and capacity are respected.

Specifications corresponding to the above characteristics are defined for each model on the corresponding technical drawings supplied on the corresponding product page on Bottle Express website.


Wooden pallets are 1200 x 1000 mm “VMF” pallets in accordance with the Spécifications of the French Association of Glassmakers Industry Standards.

All packaging components are either recyclable or reusable.

We abide by the US regulation regarding the pallets by using treated ones the ISPM 15.

Storage and bloom

After several month’s storage of products a slight deposit, called sodium exsudation (leaching / bloom) may appear on the inside of the glass. This is a natural glass process. The deposit dissolves completely during rinsing and does not impair the regular usage of the bottles. 

Some climatical conditions will accelerate the process, particularly in areas of high humidity.

Despite the measures taken during by the manufacturer and warehouse contractors, Bottle Express recommends that clients rinse, wash or blows through the bottles to eliminate possible deposit.

Delivery acceptance:

During the acceptance of the goods all reservations will be recorded in the relevant acceptance documents.

Inspection Procedure of the Batch of goods (Standards ISO 2859-1):

The Batch denotes the whole of one delivery consisting of one type of bottle, so all the N pallets of one reference in a container (N is the number of pallets).

The Sample consists of a number of pieces taken randomly from the Batch of goods according to the requirements of standards ISO 2859-1 in an ordinary sampling plan. To be representative, the sampling must be realized in (N) + 1 (for exemple: N = 22 pallets in a containers, samples must be realized into a minimum of (22) + 1 = 5.69, so of 6 pallets). 

Acceptance or rejection of the Batch of goods shall conform to the rules set forth in ISO 2859-1 (according to the Military Standard) within the framework of inspection level II at normal inspection. Clients have the option to apply the reduced inspection level (Level I), based on Acceptance Quality Level, described hereafter with reference to list of typical product defects and allowable levels.

Bottle Express LLC and/or the Manufacturer has the option to carry out a contra-inspection to approve the identification of defects. The contra-inspection should be conducted at level III as an ordinary inspection. The contra-inspection should be arranged within 60 working days from the notification of rejection of the Batch.

Quality criteria

The manufacturer implements all control measures he considers as necessary to ensure the client a defined quality level.

The buyer will also implement all measures he considers as necessary to check the ability of the manufacturer to supply the level of quality which will allow for an appropriate use of the article.

The concept of Quality choice defines the limit, size and position of defects especially with reference to minor defects in appearance and with reference to a range of representative limit samples.

Packing defects

The following  defects can appear on the pallets :

  • torn off wrapping
  • wet pallets
  • damaged pallet
  • broken ware on the pallet
  • lack of label on the pallet
  • loose plastic bond 
  • loose cardboard case
  • bottles fallen off 
  • water in the bottles

Should a delivery contain one or more damaged pallets, then the customer will make reservations to the transporter on the delivery document. If he estimates that one or several pallets could be dangerous for use, then he will isolate these pallets and contact the supplier to decide how to handle isolated pallets.

Critical defects


Defect which is liable to lead to a lack of security or to potential accidents for the users, the maintenance personnel or anyone in contact with the item concerned.

List of critical glass defects:

  • glass spike inside the bottle
  • bird swing (neck, body, bottom)
  • broken ware inside the bottle at delivery
  • hazardous external object inside the bottle at delivery
  • overpressed finish : overpress which could lead to breakage at closing
  • chipped finish at delivery
  • cutting prominent seam

Level of acceptance for critical glass defects:

The Acceptable Quality Level / A.Q.L. is 0,01.

One single critical defect leads to a reject of the corresponding glass Batch.

Major defects


Defect which, without being critical, risks leading to a failure to perform correctly, or reduce significantly the possibility of usage of the container for the purpose it has been designed for.

List of major defects:

  • cross cracks : on finish, neck, shoulder, body, bottom
  • finish out of shape or  exceeding  tolerances given in the corresponding standards 
  • dimensions exceeding tolerances  given in NFH 35-077 standard
  • prominent seam superior to 0.5 mm
  • stones with diameter superior to 3 mm which could lead to breakages
  • hollow folds on the body
  • choked neck which prevents the entry of the filling tube
  • external object, foreign body inside the bottle at delivery
  • checked bottom which could lead to breakages

Level of acceptance:

For each type of defect the Acceptable Quality Level / A.Q.L. will be 1.0.

E.G; As per statistical sampling level II & by Batch size (typically a full load):


Minor defects


Aesthetic defects which are unlikely to reduce significantly the possibility to use the product concerned  for the end it has been designed for, or for which the variation from the specifications will have no major consequences on the efficient use or functioning of the bottle.

List of minor defects:

  • blister over 2.5 mm
  • prominent seam under 0.5 mm
  • stones with a diameter larger than 1.5 mm and smaller than 3 mm
  • folds on body (hollow or bright) not leading to breakage over 3 cm, out of the capsule zone
  • external dirty marks
  • orange peel skin 
  • scuffing marks, bigger than 11,2 mm2 (height, width : 7,5x1,5 or 2.8x4)

Level of acceptance:

For each type of defect the Acceptable Quality Level will be 2.5.

Breaking rate 

Under normal circumstances of usage and functioning, identified glass defects must not lead to a breaking rate in excess of 1 out of 1000 on the average of a reselecting day.

This rate applies to a bottling rate under 8000 bottles/hour.


Please keep the pallet tag placed on the smaller side of the bulk pallets in your records.

The glass bottles traceability is mainly based on the pallet tag. Buyers will need it for any claim.

The pallet tag includes:

  • manufacturer’s name
  • article name and capacity 
  • article code
  • number of bottles per pallet
  • batch number
  • chronological number of the pallet within the batch
  • manufacturing date (month and year)

It is the bottler responsibility to ensure his own traceability between the pallets received and his own pallets of finished products.

As well as the traceability provided via pallet labels, each bottle is engraved with manufacturer’s symbol, the mould serial number and the mould number.


The buyer should address the claim by email at customerservice@bottle.express with the following information:

  • Copy of the pallet tag 
  • Description of the problem and location on the bottling line if applicable
  • Percentage of defects according to our specifications
  • Day, month and year the defect was noticed by buyer
  • Customer Name
  • Invoice Numbers
  • Date of pallets received
  • Reference of the bottle concerned
  • Number of faulty bottles in accordance with our specifications
  • Number of delivered bottles
  • Batch and pallet numbers per defect
  • Detailed description of the defects and cause of the claim 
  • Representative samples of the defects (ideally 12 samples) may be requested by Bottle Express LLC

How will my order be shipped?

The standard accessibility requirements are as follow:

  • Accessible for full size truck with 53 ft trailer (unfortunatelywe cannot deliver to residential addresses)
  • Forklift or pallet jack on site to offload the pallets
  • Loading dock
  • Crew on site to offload the pallets (The customer will be expected to unload the pallet(sonce the driver gets the pallet(sto the back of the truck)

If you do not meet any of these requirements or have special instructions for the driver such as limited accesscall ahead or appointment requiredback-in to accessone-lane road or bridegate code or call box etc please make sure to give this information to Bottle Express while scheduling your delivery and before you receive your shipping confirmationBottle Express may charge additional fees for special instructions communicated after the shipping has begun and the driver may refuse to proceed with the delivery or any added service if the provided instructions are incorrectIn this caseyou may be charge the freight back to the warehouse and a restocking fee of $80 per pallet before we can deliver you again.

Damage or issue with the delivery

All shipments are in good condition before they leave the warehouseOnce the shipment leaves the warehouse the freight carrier assumes responsibility for damage done during the shipment of your orderOnce the shipment arrives you should inspect it carefully for any damage. Once you sign for the delivery the freight company is released from any damage claimsIf damage is found you should note it on the delivery ticket and call us immediatelyIf the damage is severe refuse the shipment and call us immediately.

We must emphasize the point that it is your responsibility to carefully inspect the shipment for any sign of damage internally or externally in front of the driverYou must note any damage found in writing on the delivery ticket.

The carrier company is a subcontractor of oursThe driver and employees of the carrier and trucking companies are not employees of Bottle Express. Therefore please contact Bottle Express directly for any assistanceissue with the driver or the delivery or any concern you may have regarding your delivery.

Do you charge sales tax?

Bottle Express prices do not include sales, manufacturer's, retailer's, occupation, excise, VAT or any similar other tax, fee, duty, tariff or other charge imposed by any governmental authority on any transaction between Bottle Express and the purchaser. The purchaser shall furnish evidence of any sales tax exemption and shall warrant the validity and accuracy thereof. In all events, any such tax, fee, duty, tariff or other charge, even if initially advanced by Bottle Express, shall be the sole obligation of, and shall be promptly paid by the purchaser.
